Sean Caldon, 55, pleaded guilty to involuntary manslaughter on Monday in connection with a fatal boat crash that claimed the life of Jose “Gomie” Gomez on Lake Pend Oreille last September. The plea agreement, entered as a Rule 11 binding agreement, resolves criminal charges stemming from the incident on Cottage Island.
Under the terms of the agreement, a misdemeanor charge of operating a watercraft under the influence will be dismissed at sentencing. Caldon faces a sentencing hearing scheduled for October 22, when a judge will determine his final sentence within parameters agreed upon by both the defense and the state.
Sentencing Recommendations Diverge
Idaho prosecutors have recommended an underlying sentence of 10 years—five years fixed and five years indeterminate—plus five years of probation and 270 days in jail. Caldon’s defense attorney is expected to recommend a significantly lighter sentence of 90 days in custody. The felony fine in the case has been set at $1,000.
Without the plea agreement, Caldon faced potential sentences of up to 10 years in prison and fines up to $10,000, according to court records. The binding nature of the Rule 11 agreement means the judge must accept the negotiated terms unless she determines the plea was not voluntary or that Caldon did not fully understand the consequences.
Conditions and Restrictions
Caldon is prohibited from operating any watercraft during the five-year probation period. He is also required to use an ignition interlock system in his vehicle, a device that prevents a motor vehicle from starting if alcohol is detected on the operator’s breath.
Caldon remains in custody at Bonner County Jail pending his October sentencing.
Details of the Fatal Incident
The boat crash occurred on September 20, 2025, when Gomez was ejected from Caldon’s watercraft on Cottage Island. Emergency responders from the Bonner County Sheriff’s Office, Idaho State Police, Bonner County Emergency Services, Sam Owen Fire, and Sandpoint Fire responded to the scene. Sam Owen Fire located Gomez on land and initiated lifesaving measures, but he was pronounced deceased at the scene.
The Bonner County Prosecutor’s Office filed criminal charges against Caldon on October 14, 2025, nearly three weeks after the incident.
